Terms of Service

 

Waivers & Liability: 

South Bay Dog Training LLC – Nathalie Mosbach and/or Kimberly McCarty - will endeavor to create as safe an environment as possible for the training of my dog and will offer only sound, safe, and responsible training and training instructions.  However, I recognize that South Bay Dog Training, from here on SBDT – Nathalie Mosbach and/or Kimberly McCarty - are not responsible for any unintentional errors, omissions, or incorrect assertions.  I understand that the recommendation of any other product or service is not a guarantee of my satisfaction with that product or service. Further, I am and will remain responsible for the actions of my dog at all times and I hereby agree to indemnify and hold harmless SBDT – Nathalie Mosbach and Kimberly McCarty of any and all claims of injury, expense, costs, or damages caused by the actions of my dog while under SBDT – Nathalie Mosbach and Kimberly McCarty instruction or control and under my own care as a result of following training instructions. I have been told by SBDT – Nathalie Mosbach and Kimberly McCarty and understand the inherent risks of owning a dog, including but not limited to the risk of dog bites to myself or others.

COVID-19:

If South Bay Dog Training - SBDT - is unable to operate due to any reason associated with the Pandemic / COVID-19, you agree and acknowledge that South Bay Dog Training's only obligation will be to reschedule any classes that are missed. 

 

You agree to wear a mask which covers your nose and mouth while inside the building if county mandates are in effect. If you are medically exempt, South Bay Dog Training will provide reasonable accommodation by providing you with the ability to connect remotely to the group class with 48 hours notice and provide coaching as we would in person. 

You agree to maintain 6 feet of social distancing which may be increased if deemed necessary by any staff member. 

If you fail to wear a mask in the facility or during any contact with South Bay Dog Training’s staff during a mask mandate, your contract is terminated without refund. Otherwise, masks will be optional if no county mandates are in place.

Please wait in your vehicle or use the outdoor green stretch to have your dog eliminate before coming in. We provide poop bags both inside and outside. 

You agree and acknowledge that you may not bring your dog to South Bay Dog Training if any of the following exist: 

  • you or anyone in your household has been diagnosed with COVID-19 and have not been found to be cleared of the virus;

  • you or anyone in your household has been exposed to COVID-19 within the last 10 days, or;

  • you or anyone in your household show signs of having COVID-19

 

You agree and acknowledge that South Bay Dog Training LLC may refuse entrance or, if entrance has already happened, require you to leave if you show signs of sickness for any in-person training and may cease any outdoor training if you show signs of sickness.

You agree and acknowledge that South Bay Dog Training, LLC may require additional procedures be put into place due to COVID-19 to ensure that South Bay Dog Training LLC can keep both staff members and other clients safe.

Class Rules:

Your space in class will be guaranteed once we have received your completed SERVICE AGREEMENT and full payment. You must show proof that your dog has age-appropriate vaccinations. Puppies under 20 weeks need to be two weeks past their first vaccination and do not need to have a rabies vaccination. There are no make-up classes but we can provide you with the class handout of the missed class. Carefully consider your schedule and your commitment to training your dog before you register for classes. If you need to miss a session, you will still receive the homework for that class. Children are welcome in our classes. They must be under parental control at all times. For safety, they may not run, yell or sit on the floor. They may not approach other dogs in class without the express permission of that dog’s owner.

 

Equipment you will need:

  • Lots of small, moist treats

  • Favorite toy & food filled toy such as Kong

  • Mat (such as a bathmat) - Not needed for PuppyGarten Classes

  • Flat collar, martingale or clip harness (no prong, choke or e-collars allowed)

  • 6ft leash (no retractable)

We do NOT allow choke chains, pinch collar, slip leads, shock collar or retractable leashes, this is a force free training environment.

Policy:

I understand and agree that South Bay Dog Training - SBDT - does not offer free evaluations or consultations and that the first visit is considered a session. I agree and understand that a “no-show” for a scheduled training appointment will be counted as a session. I understand that I must practice with my dog in-between sessions in order to get the most benefit and success from any training program. All sessions are paid at the beginning of the (first) session. 

Payment: cash, check or credit card. I agree to pay $35 fee if my check is returned unpaid for any reason and to promptly make any returned payment good. Services are pre-paid through the website.

 

Pictures:

We may capture your pet’s likeness while being in SBDT’s care. Client hereby authorizes SBDT’s the use and/or reproduce of the dog’s likeness in print or other media. The client agrees that he/she will not be compensated for any such use but may request and receive copies of the print.

 

Trainer agrees to exercise due and reasonable care of Dog while at SBDT. However, Trainer is not liable for loss or damage from disease, death, running away, theft, fire, injury to persons, other dogs, or property by Dog during or after the term of this Agreement.

 

Cancellation & Refund Policy:

Classes: 

Carefully consider your schedule and commitment before registering for classes. There are no refunds after fees are paid. Unused and paid fees are transferable to other classes or services if the trainer deems the reason for stopping current service is reasonable. If your dog is unable to attend due to an injury or illness during enrollment, you will be moved to another class without additional cost. If the instructor deems a dog inappropriate for group classes due to excessive aggression or extreme anxiety, you will receive a full refund minus any classes you attended. If we cancel a class, you will receive a full refund. Should classes be cancelled due to emergency situations such as weather or illness related issues we will offer an interactive online alternative which allows you to train your dog while interacting with your dog trainer. 

Private Training:

I understand I need to provide at least 24 hours cancellation notice, or be not present at time of scheduled appointment, sessions fees are still due. For a package deal, the session will still be counted as one session. Sessions cancelled on time can be rescheduled if time and space is available but must be done as soon as possible or within 180 days of starting the first session. For optimal training results sessions should not be further apart than 7 days.

 

Socials:

We require a one time service agreement to be signed before booking a social date. I understand I need to provide at least 24 hours cancellation notice or reschedule my social online, or be not present at time of scheduled appointment, social fees are still due. 

 

Unless noted otherwise no refunds will be given for no-shows.

 

Termination:

SBDT shall terminate if (a) in SBDT’s judgment Dog is dangerous or vicious to SBDT or other person or animal, or interferes with the training of other dogs, or (b) Client breaches any term or condition of this Agreement, or (c) Client requests service termination. I understand that if I terminate this agreement at any time I am legally bound to the policy listed in this agreement.

 

I have read, acknowledge and agree to all terms, conditions and legal provisions as set forth.
